Preamble

These Terms & Conditions are drafted in accordance with applicable Italian and European legislation, including, without limitation, Legislative Decree 206/2005, Legislative Decree 70/2003 and Directive 2011/83/EU.

1. Scope

These Terms & Conditions govern the sale of products offered by Bagotica through its online channels.

Sales and deliveries are carried out exclusively within the European Union.

By placing an order, the Customer fully accepts these Terms & Conditions, the Shipping & Delivery Policy, the Return & Refund Policy and the Privacy Policy pursuant to Regulation (EU) 2016/679 (GDPR).

2. Products

Bagotica sells luxury pre-owned items only.

Each product is accurately described and available as a single piece.

3. Contract formation

The sales contract is concluded only upon confirmation of payment and issuance of the order confirmation by Bagotica.

4. Prices

All prices are displayed in Euro (EUR) and include applicable taxes in accordance with current legislation.

Price changes do not affect orders already confirmed.

5. Payment methods

Bagotica accepts payments exclusively in Euro (EUR) and through payment methods available within the European Union.

Accepted payment methods are:

– SEPA bank transfer — available for all order amounts;

– PayPal — available for orders up to €3,000;

– card payments via Stripe — available for orders up to €3,000.

For orders exceeding €3,000, payment is accepted exclusively by SEPA bank transfer.

Any applicable payment processing fees are clearly displayed at checkout before the Customer confirms the order.

6. Shipping

Shipping is organized and managed directly by Bagotica using professional tracked courier services.

Shipments are carried out exclusively within the European Union.

Standard shipping fees are applied according to destination:

– Italy: €130
– Europe Standard: €170
– Europe Extended: €200

Selected items may qualify for complimentary shipping, as indicated at checkout.

The applicable shipping fee is determined by the delivery destination and the nature of the item and is displayed at checkout before the order is placed.

The courier and shipping method are selected by Bagotica. For high-value items, appropriate insurance is arranged by Bagotica according to the value of the item.

7. Non-refundable costs

Return shipping costs, including any applicable insurance costs, are borne by the Customer. Payment processing fees are non-refundable to the extent permitted by applicable law. Any other refunds are handled in accordance with applicable consumer legislation.

8. Right of withdrawal and returns

The right of withdrawal may be exercised within the limits and according to the procedures set out under applicable European law.

9. Limitation of liability

Bagotica shall not be liable for delays or failures caused by force majeure events, carrier disruptions or improper use of payment methods.

10. Governing law and jurisdiction

These Terms & Conditions are governed by Italian law.
Without prejudice to any mandatory consumer protection provisions, exclusive jurisdiction for any dispute shall lie with the Court of Rome, Italy.
