Preamble

These Terms & Conditions are drafted in accordance with applicable Italian and European legislation, including, without limitation, Legislative Decree 206/2005, Legislative Decree 70/2003 and Directive 2011/83/EU.

1. Scope

These Terms & Conditions govern the sale of products offered by Bagotica through its online channels.

Sales and deliveries are carried out exclusively within the European Union.

By placing an order, the Customer fully accepts these Terms & Conditions, the Shipping & Delivery Policy, the Return & Refund Policy and the Privacy Policy pursuant to Regulation (EU) 2016/679 (GDPR).

2. Products

Bagotica sells luxury pre-owned items only.

Each product is accurately described and available as a single piece.

3. Contract formation

The sales contract is concluded only upon confirmation of payment and issuance of the order confirmation by Bagotica.

4. Prices

All prices are displayed in Euro (EUR) and include applicable taxes in accordance with current legislation.

Price changes do not affect orders already confirmed.

5. Payment methods

Bagotica accepts only payment methods issued and used within the European Union.

Accepted methods include:

– SEPA bank transfer (recommended);

– PayPal accounts registered within the European Union;

– cards and payment links via Stripe, issued within the European Union.

Any fees applied by payment service providers are determined and retained by the respective providers and are non-refundable.

6. Shipping

Shipping is organized and managed directly by Bagotica via tracked express couriers.

Shipments are carried out exclusively within the European Union.

Shipping fees are applied as a flat rate based on destination:

– Italy: €130

– Other European Union countries: €170

Shipping insurance is arranged internally by Bagotica.

7. Non-refundable costs

Shipping costs (both outbound and return), costs related to shipping insurance management and payment provider fees are non-refundable and remain the responsibility of the Customer.

8. Right of withdrawal and returns

The right of withdrawal may be exercised within the limits and according to the procedures set out under applicable European law.

9. Limitation of liability

Bagotica shall not be liable for delays or failures caused by force majeure events, carrier disruptions or improper use of payment methods.

10. Governing law and jurisdiction

These Terms & Conditions are governed by Italian law.
Without prejudice to any mandatory consumer protection provisions, exclusive jurisdiction for any dispute shall lie with the Court of Rome, Italy.
